A-12 AVENGER CASE DECISION EXPECTED IN SEPTEMBER: A decision on the long-pending A-12 Avenger court case, concerning the 1991 cancellation of the U.S. Navy aircraft program, is expected this September, according to a source close to the case. "An oral argument will take place on June 29 in front of Judge Hodges [in the U.S. Court of Federal Claims] and a decision is expected in September," Jim Stevenson, author of "The $5 Billion Misunderstanding," a book about the collapse of the A-12 program, told The DAILY. The case was sent back to Judge Robert Hodges Jr. in the fall of 2003, where it originated, after it left the U.S. Court of Appeals for the Federal Circuit. In January 1991, the Navy canceled the $4.8 billion A-12 program, which was intended to build a carrier-borne stealth attack aircraft, after General Dynamics and McDonnell Douglas, now part of Boeing, couldn't meet program schedules. The companies sued. According to General Dynamics, losing the case "would result in a liability for the company of approximately $1.2 billion ... to be taken as a charge against discontinued operations." Upon losing, Boeing would have to pay the government approximately $1.5 billion in pretax charges, the company said. The contractor payments would include $1 billion in interest for what the government is claiming is an undelivered line item, the completion of the critical design review, said a source who works closely with the A-12 case but asked not to be identified. Also, if the contractors lost, they collectively would not receive $1.35 billion they have already spent on the A-12 program, the source said. (Aerospace Daily & Defense Report)
